California Voter Roll Maintenance Challenge

Judicial Watch v. Weber

Lawsuit filed by Judicial Watch and Libertarian Party of California against California Secretary of State Shirley Weber (D) and the state of California challenging the state’s voter roll maintenance procedures under the National Voter Registration Act (NVRA). The plaintiffs argue that Weber and the state of California have failed to conduct a program to cancel the registrations of ineligible voters in California or publicly disclose all the records related to the state’s efforts to ensure the accuracy of its voter rolls, in violation of Section 8 of the NVRA. The plaintiffs ask the court to find California in violation of the NVRA, require the state to set up a public program to remove ineligible voters from the state’s voter rolls and provide them all records on the state’s efforts to maintain its voter rolls.

The plaintiffs filed their complaint on May 6, 2024. California responded on July 5, 2024.

STATUS: A motion to dismiss this case is pending before the court. The parties await a decision.
