These Terms of Service (“Terms”) apply to your access to and use of the Democracy Docket website, newsletters, emails, subscriptions, merchandise, and other communications (collectively, the “Site”) provided by Democracy Docket, LLC (“Democracy Docket,” “we,” or “us”). This is a legally binding agreement between you and Democracy Docket that governs your use of our Site, newsletters, and other products, features and services Democracy Docket provide (our “Services”). By accessing or by using our Site, you agree to these Terms, and any terms incorporated by reference. If you do not agree to these Terms, do not use our Site.
We may make changes to these Terms from time to time. When we do, we will post the updated Terms on the Site and revise the “Last Updated” date. If we make material changes, we may also provide notice by email, through your account, or by posting a prominent notice on the Site. The Site and the articles, newsletters, reports, images, videos, graphics, text, and other content available through this Site (the “Site Materials”) are owned by the Democracy Docket, or our licensors or other third parties, and are protected by US and international copyright laws. Except as explicitly stated in these Terms, all rights in and to the Site and the Site Materials are reserved by us, or our licensors, and may be used solely as authorized in these Terms. The Site and the Site Materials are provided solely for informational purposes and may be downloaded and used solely for your own lawful use in accordance with these Terms. All materials published or available on the Site (including, but not limited to text, photographs, images, illustrations, designs, audio clips, video clips, “look and feel, data, or compilations) are protected by copyright, and owned or controlled by Democracy Docket or the party credited as the provider of the content.
Any use of the Site or the Site Materials other than as specifically authorized herein, without our prior written permission, is strictly prohibited, will terminate the license granted herein and will violate our intellectual property rights.

The opinions expressed in or through the Services are the opinions of the individual author and may not reflect the opinions of Democracy Docket.
- Prohibited Conduct and Content
You are solely responsible for your use of the Site and use it at your own risk. By using the Site, you agree that you will not violate any applicable law, contract, intellectual property right or other third-party right or commit a tort, and you are solely responsible for your conduct while using our Site. You may only post or otherwise share content that is nonconfidential and that you have all necessary rights to disclose, including the lawful right to distribute and reproduce such content. You shall not post, upload to, transmit, distribute, store, create or otherwise publish through our Site any of the following:
- Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory or fraudulent;
- Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party. By posting any content, you represent and warrant that you have the lawful right to distribute and reproduce such content;
- Content that contains or depicts any statements, remarks or claims that do not reflect your honest views and experiences;
- Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
- Unsolicited promotions, advertising or solicitations;
- Private or personal information of a third party without such third party’s consent;
- Viruses, corrupted data, or other harmful, disruptive or destructive files or content; or
- Content that, in our sole judgment, is objectionable or restricts or inhibits any other person from using or enjoying the Site or may expose us or our users to any harm or liability of any type.
You further agree that you are solely responsible for your conduct while accessing or using our Site, and you agree that you will not do any of the following in connection with our Site or its users:
- Use our Site other than for their intended purposes and in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying our Services or that could damage, disable, overburden or impair the functioning of our Services in any manner;
- Use or attempt to use another user’s account without authorization from us and that user;
- Impersonate or post on behalf or any person or entity or otherwise misrepresent your affiliation with a person or entity;
- Engage in any stalking, intimidating, threatening, predatory or otherwise harassing conduct or cause discomfort to other users;
- Copy, reproduce, distribute, publicly perform or publicly display all or portions of our Site, except as expressly permitted by us or our licensors;
- Modify our Site, remove any proprietary rights notices or markings, or otherwise make any derivative works based on our Site;
- Reverse engineer any aspect of our Site or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of our Services;
- Use any data mining, robots, or similar data gathering or extraction methods designed to scrape or extract data from our Services;
- Develop or use any applications that interact with our Site without our prior written consent;
- Bypass or ignore instructions contained in our robots.txt file;
- Send, distribute or post spam, unsolicited or bulk commercial electronic communications, chain letters or pyramid schemes;
- Send any unsolicited commercial messages;
- Use our Site for any illegal or unauthorized purpose, or engage in, encourage or promote any illegal activity that violates these Terms; or
- Circumvent or attempt to circumvent any filtering, security measures or other features that we may from time to time adopt to protect our Services, our users or third parties.
- Access and Use of Services
- Registration. You will be required to register and create an account with Democracy Docket in order to access and use certain features of the Services. If you choose to register for the Services, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the registration form. Registration data and certain other information about you are governed by our Privacy Policy. Each individual user must be of legal age to form a binding contract through creating and maintaining an account and using the Service (in many jurisdictions, this age is 18) and agrees to be bound by these Terms.
- Accounts and Security. You may never use another’s account, and you may not provide another person with the username and password to access your account. You are fully responsible for any and all activities that occur under your password or account, including compliance with applicable federal, state, or local laws, including but not limited to Privacy Laws (defined below), and it is your responsibility to ensure that your password remains confidential and secure. You agree to (a) immediately notify Democracy Docket of any unauthorized use of your password or account or any other breach of security, and (b) take necessary steps to protect your account from unauthorized access. Democracy Docket will not be liable for any loss or damage arising from your failure to comply with this Section.
- Mobile Services. The Service may include certain services that are available via a mobile device, including (i) the ability to upload or post content to the Service via a mobile device, (ii) the ability to browse the Service and the Site from a mobile device and (iii) the ability to access and participate in Services through an application downloaded and installed on a mobile device (collectively, the “Mobile Services”). To the extent you access the Service through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices.
- Cancellation and Refunds. You may cancel your subscription to any fee-based Service at any time through the subscriber portal at account.democracydocket.com or with help from our Help Center. The timing and effect of cancellation are described below.
All subscriptions renew automatically at the end of the applicable subscription term unless canceled before the applicable renewal date. Annual subscribers will receive notice at least 15 days before their subscription renews.
For monthly subscriptions, subscription charges are non-refundable once billed. A cancellation will prevent your monthly subscription from automatically renewing at the end of the then-current subscription month and you will continue to have access to members-only content through the remainder of the subscription month for which you have already paid.
For annual subscriptions, you may cancel within seven (7) days after the date of purchase or renewal and request a full refund. If a refund is issued, your subscription will terminate immediately and your access to members-only content will end. If you cancel more than seven (7) days after the date of purchase or renewal, your annual subscription fee is non-refundable. Your cancellation will prevent your annual subscription from automatically renewing at the end of the then-current subscription term, and you will continue to have access to members-only content through the remainder of the annual subscription period for which you have already paid.
Gift subscriptions are one-time purchases and do not automatically renew, and cannot be canceled or refunded.
Except as expressly provided above or as otherwise required by applicable law, all payments are final. Notwithstanding the foregoing, Democracy Docket reserves the right, in its sole discretion, to issue refunds or credits in exceptional circumstances. Your rights under applicable law may vary based on your jurisdiction and may supersede portions of this policy.
- Customer Support. Democracy Docket endeavors to provide you with reasonable customer support and maintenance during standard business hours for any fee-based Services via e-mail to [email protected]. Democracy Docket does not guarantee that the support will be available at a certain time or that Democracy Docket will respond within a certain time or that it will have the ability to resolve all problems in connection therewith.
- Fees and Payment Terms
Democracy Docket charges subscription fees per the rates and options provided on the Site. All subscriptions are automatically renewed at the end of the subscription term.
Monthly subscriptions are charged on the same calendar day of each month as the date the subscription began. If a month does not contain that calendar day, the subscription will be charged on the last day of that month.
Democracy Docket reserves the right to change its prices and to institute new charges at any time, upon posting such new pricing on the Site, which may also be sent by email. Use of the Service by you following such notification constitutes your acceptance of any new or increased charges.
All subscriptions are auto-renewing, meaning that once you sign up for a subscription, your credit card will be charged the renewal fee at the beginning of the period for which you have registered for a subsequent renewal period. The renewal fee charged to your account will be the fee then in effect for the period for which you are renewing. Renewal notices will not be sent to you if you elect a monthly subscription. If you fail to cancel your account prior to your monthly renewal date, then your credit card will be charged the full amount for the renewal period. Democracy Docket may change subscription fees at any time and from time to time. You may be notified of any price changes either via email or through a pop-up window on the Site. Continued use of the Service following a price change constitutes your acceptance of the applicable price change. If you object to any price changes adopted by Democracy Docket, then your sole remedy is to discontinue use of the Service and cancel your account prior to your credit card being charged a recurring subscription fee at the changed rate. The provisions of this paragraph are subject to all applicable local laws.
You agree to pay all applicable fees related to your use of the Services. All fees are based on Services purchased, regardless of actual usage. We may suspend or terminate your paid account and/or access to our paid Services if your payment is late and/or your offered payment method cannot be processed. All fees are exclusive of any applicable sales, use, import or export taxes, duties, fees, value-added taxes, tariffs or other amounts attributable to your use of the Services (collectively, “Taxes”). You are solely responsible for the payment of any such Taxes. In the event we are required to pay Taxes on your behalf, you shall promptly reimburse us for all amounts paid. Taxes or any additional charges, if applicable, will be itemized in your order confirmation email.
Terms of payment are within our sole discretion and unless otherwise agreed to by Democracy Docket, in writing, we must receive payment before our acceptance of an order. Payments for items through our Site or for our Services are made through third party platforms, which allow you to use a credit or debit card for purchases. Therefore, when making purchases you are subject to that third-party’s terms of service and privacy policies.
By purchasing Services, you represent and warrant that (i) the payment information you supply for purchases is true, correct, and complete, (ii) you are duly authorized to use that payment for the purchase, (iii) charges incurred by you will be honored by your bank or credit card company, and (iv) you will pay all fees associated with your purchase, including all applicable taxes, if any. In the event your payment is returned for any reason, you will automatically be charged any bank fee or third-party payment processor fee imposed on Democracy Docket, in addition to our own processing fee, as determined by Democracy Docket. If this occurs, we retain the right to collect, and you agree to pay any current and past due balances at any time after the returned payment.
Democracy Docket reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel any purchases. You agree to update your Account and other information, including your email address and credit card information, promptly so that we can complete your transactions and contact you as needed.
Any payments made through the Site and/or for Services are final and non-refundable.
- Communications. You consent to accept and receive communications from us, including email, and calls to the telephone number you provide to us as described in our Privacy Policy. Standard message and data rates applied by your cell phone carrier may apply to the text messages we send you.
- User Content and Feedback.
Certain features of the Services may permit you to submit or post information, questions, comments, suggestions, ideas, feedback, or other materials (“User Content”). You retain ownership of any User Content you submit through the Services.
By submitting User Content, you grant Democracy Docket a non-exclusive, worldwide, royalty-free license to use, reproduce, host, store, display, distribute, modify (solely as necessary for formatting or technical purposes), and otherwise use such User Content as reasonably necessary to operate, maintain, improve, and provide the Services, communicate with users, display User Content through the Services as intended, and comply with applicable law.
You represent and warrant that: (a) you own or otherwise have all rights necessary to submit the User Content; (b) your User Content does not infringe or violate the rights of any third party, including intellectual property, privacy, or publicity rights; (c) your User Content complies with applicable law and these Terms; and (d) any information you provide in connection with the Services is accurate, current, and complete, and you will promptly update such information as necessary.
Any suggestions, ideas, recommendations, comments, or other feedback you provide regarding the Services (“Feedback”) may be used by Democracy Docket for any purpose, commercial or otherwise, without acknowledgment, compensation, or other obligation to you. To the extent necessary, you grant Democracy Docket a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, publish, distribute, and incorporate such Feedback into the Services and our business operations.
Democracy Docket is not responsible for the accuracy, completeness, legality, reliability, or quality of any User Content and has no obligation to review, monitor, verify, or validate User Content submitted by users. Certain information you provide through the Services may also be governed by our Privacy Policy.
- Linking to the Site
You may link to the Site through your own website, blog, or social media pages, provided you do so in a way that is fair and legal and does not damage Democracy Docket’s reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent.
You must not cause the Site or portions of it to be displayed on, or appear to be displayed by, any other site, whether through framing, deep linking, in-line linking, or any similar method. Authorized subscribers may share links to specific content on the Site for internal business purposes, but may not republish, embed, or display such content on any external website or platform.
We reserve the right to withdraw linking permission without notice and may disable any linking functionality at any time in our sole discretion. You agree to cooperate with us in stopping any unauthorized framing or linking immediately upon our request
- Age Restrictions
You must be at least 18 years old to use the Site or participate in the Services.
We do not knowingly collect personal information from children under 13. If you are under 13, you are not permitted to use our Site or any related Services and should not provide us with any Personal Information about yourself, including your name, address, telephone number, email address, or any screen name or user name you may use.
If we learn we have collected or received Personal Information from a child under 13 (without verified parent or guardian consent), we will delete that information in accordance with the Children’s Online Privacy Protection Act. If you believe we might have any information from or about a child under 13, please contact us at [email protected] and we will take reasonable steps to ensure that such information is deleted from our records.
- Geographic Restrictions
The Services and Site are controlled and offered from our facilities based in the United States. If you access the Site from outside of the United States, you do so at your own initiative and are responsible for compliance with applicable local laws.
- Trademarks and Intellectual Property
The Site, including its logos, slogans, text, graphics, images, photographs, videos, illustrations, information, data, software, and other content and materials contained therein (and the selection, arrangement and presentation thereof), are owned by Democracy Docket or our licensors and are protected under both U.S. and international intellectual property laws. Subject to your compliance with these Terms, you are granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use the Site and to download and print materials from the Site for your own lawful purposes, subject to these Terms. You may not reproduce, distribute, republish, sell, license, or otherwise commercially exploit any content made available through the Services except as expressly authorized by Democracy Docket. Any other access, use, copying, distribution, retransmission or modification of our Site, without our prior written permission, is strictly prohibited and will automatically terminate the license granted under these Terms and may violate our intellectual property or other proprietary rights. Reference to any third-party products, services, processes, organizations, or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by Democracy Docket unless expressly stated.
- Copyright Complaints
Democracy Docket respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied on any of the Site in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify us of your infringement claim in accordance with the procedure set forth below.
(A) Democracy Docket will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws with respect to any alleged or actual infringement. To be effective, the notification must be in writing and contain the following information:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
- A description of the copyrighted work or other intellectual property that you claim has been infringed;
- A description of where the material that you claim is infringing is located on the Services, with enough detail that we may find it on the Services;
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
(B) Counter-Notice
If you believe that your Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to upload and use the content in your Content, you may send a written counter-notice containing the following information to Democracy Docket at [email protected]:
- Your physical or electronic signature;
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
- A statement that you have a good-faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
- Your name, address, telephone number, and email address, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If we receive a counter-notice, Democracy Docket will send a copy of the counter-notice to the original complaining party, informing that person that it may replace the removed content or cease disabling it in ten (10) business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in ten to fourteen (10 to 14) business days or more after receipt of the counter-notice, at our sole discretion.
(C) Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Democracy Docket has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit or terminate access to the Services of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
- Third-Party Content, Products, and Sites.
We may make third-party articles, links, products, services, events, advertisements, and other content available through the Site or provide information about third-party organizations, events, products, services, or activities (collectively, “Third-Party Content and Information”). We provide Third-Party Content and Information as a service to those interested in such content. Your dealings, correspondence, or interaction with third parties are solely between you and the third party and your access to and use of any Third-Party Content and Information is solely at your own risk. Democracy Docket does not control or endorse, and makes no representations or warranties regarding, any Third-Party Content and Information.
The Site may also contain links to third-party websites and resources, including links contained in advertisements, banner advertisements, and sponsored content. These links are provided for your convenience only. Links to external sources do not constitute editorial endorsement of those sources or their content, and we accept no responsibility for the contents of any linked website or for any loss or damage that may arise from your use of them. If you access any third-party website linked from the Site, you do so entirely at your own risk and subject to the terms of use for that website.
We make no representations concerning content posted by users in comments sections or on our social media pages, and we are not responsible for the accuracy, copyright compliance, legality, or decency of such content. You release us from all liability relating to user-submitted content. We reserve the right to remove user-submitted content at our sole discretion but assume no obligation to monitor or moderate such content.
- Modification, Suspension, or Cancellation
Any of the material on the Site may be out of date at any given time and we are under no obligation to update such material. However, we reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Site or Services, including processing of our products, with or without notice to you. You agree that Democracy Docket shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Site or Services. In addition, we reserve the right to terminate your access to the Site or Services for any reason, and to take any other actions that we, in our sole discretion, believe to be in the interest of the Site, our Services, Democracy Docket, and our users and clients as a whole.
- Reliance on Information Posted
The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site or by anyone who may be informed of any of its contents.
- Limits on Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL DEMOCRACY DOCKET BE LIABLE TO YOU FOR ANY LOST PROFITS OR REVENUES, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR EMOTIONAL DISTRESS RELATED TO OR RESULTING FROM ANY ASPECT OF OUR SERVICES OR THE SITE, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OR LOSSES, ARISING OUT OF (I) THE SERVICES, (II) THE SITE, (III) THESE TERMS, (IV) SITE CONTENT OR THIRD-PARTY CONTENT, OR (V) ANY OTHER ASPECT OF OUR SERVICES OR SITE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (BREACH OF CONTRACT, A BREACH OF WARRANTY, NEGLIGENCE, PRODUCTS LIABILITY, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO INDIVIDUAL MEMBER, OFFICER, OFFICIAL, EMPLOYEE, VOLUNTEER, AGENT OR AFFILIATE OF DEMOCRACY DOCKET SHALL BE PERSONALLY LIABLE HEREUNDER, AND NO RECOURSE SHALL BE HELD AGAINST ANY SUCH PARTY’S ASSETS.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
In no event shall our total liability to you for all damages (regardless of whether the claim for such damages is based in contract, tort, strict liability, or otherwise) exceed the greater of $100 or the amounts paid for the Services during the twelve (12) months preceding the date that the claim for damages accrued.
- Indemnification and Release
To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless Democracy Docket and its independent contractors, service providers, and consultants, successor organizations, and each of their respective officers, directors, agents, partners and employees (individually and collectively, the “Indemnified Parties”) from and against any losses, liabilities, claims, demands, damages, expenses or costs (“Claims”) arising out of or related to (a) your Feedback or your use of any Site Materials; (b) your violation of these Terms; (c) your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); or (d) your misconduct in connection with the Site or the Site Materials. You agree to promptly notify Indemnified Parties of any third-party Claims, cooperate with Indemnified Parties in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). You also agree that the Indemnified Parties will have control of the defense or settlement, at the Indemnified Party’s sole option, of any third-party Claims.
- Disclaimers
Your use of our Site and Site Materials is at your sole risk. Except as otherwise provided in a writing by us, our Site and any Site Materials contained therein are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. - Governing Law and Venue

Any dispute between the parties will be resolved in the state or federal courts of the District of Columbia and the United States, respectively, sitting in the District of Columbia.
