This Privacy Policy is incorporated by reference into our Terms of Service.

This Privacy Policy applies only to information we collect:

Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services.

We may provide additional or different privacy policies that are specific to certain features, services, or activities.

We may update this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the Privacy Policy. If we make material changes to our information practices, we will provide additional notice where required or appropriate, such as by email or through a prominent notice on the Site, before the changes become effective. COLLECTION OF INFORMATION

The Personal Data That We Collect or Process

“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information (for example, account information such as name, postal address, and email address, credit card number, or any other identifier we may use to contact you online or offline.

Information You Provide to Us

  • We collect information you provide directly to us. For example, we collect information when you fill out a feedback form on the Site, sign up to receive our newsletter, or otherwise communicate with us. The types of information we may collect include your name, email address, name of your organization or employer or other identifying information you choose to provide us. 
  • Payment information, including credit card or debit card information and information about the payment methods and services (such as PayPal or Venmo) you use in connection with the Services.
  • Account history, including information about your subscription, account, transactions, purchases, and order history.

Information We Collect Automatically When You Use the Site

  • LOG INFORMATION:

We log information about your use of the Site, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Site.

  • DEVICE INFORMATION:

We may collect information about the computer or mobile device you use to access our Site, including the hardware model, operating system and version, device identifiers and mobile network information.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

Information Collected by Cookies and Other Tracking Technologies:

We use cookies, pixels and similar technologies to collect information, operate the Site, understand how visitors use the Site, improve performance, measure the effectiveness of our communications and advertising and enhance user experience. This may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that helps us to improve our Site and your experience, see which areas and features of our Site are popular and count visits. We may also collect information using web beacons (also known as “tracking pixels”). Microsoft Clarity and Microsoft Advertising

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. These tools record interactions with our Site, which may include mouse movements, clicks, scrolling behavior, and in some cases, text entered into fields. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Please note that session replay recordings may capture information you enter or interact with on our Site. Children’s and Minors’ Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 13. If we learn we have collected or received personal data from a child under 13 years old without verification of parental consent, we will delete that information. 

USE OF INFORMATION

We may use information about you for various purposes, including to:

  • Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.
  • Provide, maintain and improve our Site;
  • Provide and deliver the information you request;
  • Send you confirmations, technical notices, updates, security alerts, support and administrative messages and provide technical support;
  • Request feedback and to otherwise contact you about your use of the Site;
  • Respond to your submissions, comments, questions and requests and provide customer service;
  • Send you newsletters and alerts and otherwise provide you with information you request or that we think will be of interest to you, such as sending you information to keep you informed about various issues, events, resources, and services;
  • Help connect you with other supporters, and to solicit volunteers, donations and support for people, issues and organizations that we support;

  • Use information collected through our services and third-party platforms (including HubSpot) to deliver targeted advertising on third-party platforms, including Meta.

SHARING OF INFORMATION

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • Service Providers and Volunteers: with vendors, consultants and other service providers or volunteers who need access to such information to perform services for us (e.g. hosting, analytics, communications, security), under appropriate confidentiality and use limitations;
  • Advertising and Analytics Partners. With advertising, analytics, and marketing partners that assist us in understanding how users interact with the Site, measuring the effectiveness of our communications, and delivering and evaluating content and advertising. These partners may collect information through cookies, pixels, and similar technologies as described in this Privacy Policy. Specifically, we use HubSpot to process and store contact and payment information, and we may use data collected through HubSpot to deliver targeted advertising on third-party platforms, including Meta
  • Legal Compliance and Protection. In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation. Enforcement of our Agreements and Protection of Rights. To enforce our Terms of Service and other agreements, including for billing and collection purposes, and if we believe disclosure is reasonably necessary to enforce our policies, or to protect the rights, property or safety of Democracy Docket, our employees, volunteers, users, or others; and
  • With Your Direction or Consent.  With your consent or at your direction, including if we notify you through our Site that the information you provide will be shared in a particular manner and you provide such information.
  • Aggregated/De-identified Information: We may also share aggregated or anonymized information that does not directly identify you.

Links to Other Websites

 The Site may contain links to other websites. Any personal information you provide on such linked pages is provided directly to that third party and is subject to that third party’s privacy policy, and not this Privacy Policy. We encourage you to learn about their privacy and security practices and policies before providing them with personal information. 

Social Sharing Features

 The Site may offer social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on our Site with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. ANALYTICS SERVICES PROVIDED BY OTHERS

 We may allow third parties to use cookies or other technologies to provide analytics services. These entities may collect information about your use of the Site and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by Democracy Docket and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests and better understand your online activity.

INTERNATIONAL TRANSFERS

Democracy Docket is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Site or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries.

EEA/UK Privacy. Where the GDPR/UK GDPR applies, our legal bases include consent (e.g., newsletters, certain cookies), legitimate interests (e.g., Site functionality, analytics, security, advocacy communications), and legal obligations. Individuals have rights to access, rectify, erase, restrict, object (including to direct marketing), and data portability, and to withdraw consent. Personal data is transferred to and processed in the U.S. We use appropriate safeguards for such transfers, including contractual commitments. 

YOUR PRIVACY RIGHTS

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including access/know, correct, delete, and obtain a portable copy of your personal information; and to opt out of ‘sale’ or ‘sharing’ of personal information and targeted advertising. To exercise these rights, submit a request at privacy@democracydocket.com. We will verify your identity using information we already hold and respond within applicable timelines. Important: The exact scope of these rights varies by state. There are also several exceptions where we may not have an obligation to fulfill your request.

Nevada provides its residents with a limited right to opt out of certain personal data sales. Residents who wish to exercise their sale opt-out rights may submit a request to this address: privacy@democracydocket.com. However, please know that we do not currently sell data triggering that statute’s opt-out requirements. California law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”), may provide California residents with certain rights regarding their personal information, including the right to know what personal information is collected, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising these rights.  YOUR CHOICES

 Cookies and Similar Technologies

You may manage cookies through your browser settings. Most web browsers are set to accept cookies by default. If you prefer, you can choose to set your browser to remove or reject browser cookies or other tracking technology files, or to alert you when these files are being sent. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Site.

Some browsers and browser extensions include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. COMMUNICATION PREFERENCES

Newsletters and Marketing

You may opt-out of receiving updates and newsletters from Democracy Docket by using the unsubscribe link included in those communications or by updating your communication preferences through your user portal. We honor opt-out requests within 10 business days. Our emails identify the sender and include our mailing address. Even if you opt out of marketing communications, we may still send you non-marketing messages related to your account, subscription, transactions, or your use of the Site.

SECURITY AND RETENTION AND BREACH NOTIFICATION

  • Security. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration.
  • Retention. We retain personal information only for as long as reasonably necessary to fulfill the purposes outlined in this Privacy Policy, including to provide the Site, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary depending upon the nature of the information and applicable legal requirements.
  • Breach Notification. Where required by law, we will notify you and relevant authorities of a data breach affecting your personal information.
