Oregon Congressional Redistricting Challenge
Clarno v. Fagan
Lawsuit filed on behalf of four Republican former elected officials challenging Oregon’s new congressional map drawn with 2020 census data. The petitioners argue that the map is a partisan gerrymander in violation of the Oregon Constitution, alleging it was passed “with partisan intent and for partisan purposes: to provide a more favorable Oregon congressional map for Democrats.” The suit asks the state court to block the map from going into effect for future elections and for new congressional districts to be drawn. A group of voters were granted intervention in the case to defend the map. The court determined that the map is lawful and dismissed the case with prejudice, holding that “the extensive record in this case establishes that, far from being motivated by partisan purpose, the Legislative Assembly drew the enacted map based on public input and neutral criteria—resulting in a fair map that was not drawn for a partisan purpose.”
