Montana Democratic Party v. Jacobsen
Lawsuit filed in federal court on behalf of the Montana Democratic Party, Montanans for Tester and a Montana voter challenging a provision of voter suppression law Senate Bill 319 that bans voter registration and education activities on public college campus buildings such as dorms, dining halls and athletic facilities. The suit argues that, by specifically singling out college locations but not other public buildings, this law is intended to limit the organizing efforts and political speech of Montana’s college students in violation of the First, 14th and 26th Amendments.
S.B. 319 was permanently blocked by a state court in Forward Montana v. Montana. After the state agreed to not appeal that decision, the plaintiffs in this case voluntarily dismissed their lawsuit. S.B. 319 is no longer in effect.
