Felton v. Wisconsin Elections Commission

A pro-voting lawsuit challenging malapportionment of Wisconsin’s congressional map.

Background
Wisconsin voters filed a lawsuit claiming Wisconsin’s congressional map fails to give them equal representation. After Gov. Tony Evers (D) vetoed a gerrymandered congressional map in 2021, the conservative majority on the state supreme court adopted a map that made only minor changes to the 2011 map under the “least change” principle. Voters argue that the current map does not equally distribute the population among the state’s eight congressional districts in violation of the state constitution. They ask the state’s highest court to take the case and order a new map for the 2026 election.

Why It Matters

Article 1 Section 1 of the Wisconsin constitution requires all Wisconsinites to be treated equally. Plaintiffs argue that this principle imposes a stricter equality requirement for congressional maps than the current map meets.
