Background
The New York Citizens Audit Civic Fund (NYCA) — a group of extremists known for promoting election-fraud conspiracy theories — filed a lawsuit against New York Attorney General Letitia James, claiming widespread inaccuracies in the state’s voter rolls and alleging that state election officials violated their constitutional and civil rights by suppressing their efforts to publicize supposed election irregularities. The lawsuit asserts that the state’s alleged failure to maintain accurate voter lists and to reconcile votes before certifying the 2024 election violated NYCA’s First Amendment rights to free speech and petition, constituted voter intimidation under federal law, and breached due process protections under the Fifth and Fourteenth Amendments. NYCA also accuses officials of conducting and certifying “invalid” elections in violation of the U.S. Constitution, and seeks a court order blocking the certification of future election results until the state’s voting system undergoes a full independent audit.
Why It Matters
Marly Hornik, executive director of NYCA, has been a leading promoter of unfounded claims about voter roll inaccuracies and election-related conspiracy theories. She also co-founded United Sovereign Americans, now known as Unite4Freedom, a far-right legal group that sought to disrupt the 2024 election through a wave of lawsuits challenging state voting processes across the country. Hornik has since left the group.
