Background
The Republican National Committee (RNC) and Republican nominee for Nevada Secretary of State James Carl Marchant, Jr. filed a lawsuit against current Nevada Secretary of State Francisco Aguilar (D), challenging state law and secretary of state guidance that allows certain U.S. citizens who have never lived in Nevada to vote in the state if their parent or legal guardian last resided there before leaving the country. Plaintiffs argue the law violates the Nevada Constitution’s residency requirement for voting, which states that only U.S. citizens who have “resided in the state” and meet other qualifications may vote. They are asking the court to block the law and guidance, remove affected voters from the rolls and prevent them from receiving or casting ballots.
Why It Matters
This action is part of Republicans’ nationwide legal strategy to perpetuate claims of ineligible voters casting ballots in American elections. The RNC also filed similar lawsuits against Nebraska, Virginia, Arizona, North Carolina, Michigan, and Colorado.
