State of Montana v. Biden
Lawsuit filed by the states of Kansas, Iowa, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina and South Dakota challenging a pro-voting executive order passed by President Joe Biden. Executive Order 14019, which was passed in March 2021, seeks to expand voting access and eliminate barriers to voting nationwide. The states argue that the executive order violates the Administrative Procedures Act (APA) and the 10th Amendment of the U.S. Constitution by expanding the federal government’s role in regulating voter registration and the conduct of elections. They claim the president had no legal authority to issue the order and ask the court to permanently prohibit the enforcement of Executive Order 14019.
STATUS: Proceedings in this case are stayed until Feb. 10, 2025.
