Pennsylvania Voter Roll Maintenance Challenge (Wortman)

Wortman v. Schmidt

Lawsuit filed by a voter against Pennsylvania Secretary of the Commonwealth Al Schmidt (R) and the Pennsylvania Department of State challenging the accuracy of the state’s voter rolls. The plaintiff alleges that thousands of voter registrations on Pennsylvania’s voter rolls could be invalid because the voter has either moved out of the state or moved counties within the state. He claims that the department of state has not accurately maintained Pennsylvania’s voter rolls in violation of the National Voter Registration Act (NVRA) and Pennsylvania law. The plaintiff asks the court to order the state to direct all county commissioners to notify voters with active registrations who have moved outside of their jurisdiction and to mark any voter who does not respond within 30 days as inactive in the state’s voter rolls ahead of the November 2024 general election.

RESULT: The plaintiff voluntarily dismissed his complaint on Sept. 30, 2024, thereby ending litigation.
