Background
The Republican National Committee (RNC) and two Nebraska voters filed a lawsuit against Secretary of State Robert Evnen (R), challenging a state law that allows certain individuals who have never lived in Nebraska to register and vote in the state. Specifically, the lawsuit targets a provision that permits U.S. citizens living abroad who have never resided in the state to vote in Nebraska elections if at least one of their parents is a registered Nebraska voter. The plaintiffs argue that the law violates the Nebraska Constitution, which requires voters to be residents of both the state and their voting precinct and does not allow residency to be inherited through a parent. They are asking the court to declare the law unconstitutional and block Nebraska from issuing ballots to individuals who have never lived in the state.
