Pennsylvania Vote By Mail Certification Challenge
Kelly v. Pennsylvania
Lawsuit filed by several Republican candidates and individual voters against Pennsylvania, the General Assembly, Gov. Tim Wolf (D) and Pennsylvania Secretary of State Kathy Boockvar (D) seeking to block Pennsylvania’s certification of presidential election results. Specifically, the suit asked the court to exclude mail-in ballots from the certified results or alternatively direct the General Assembly to choose its own electors. The appellate court enjoined the state from certifying remaining results pending an evidentiary hearing, which the state supreme court promptly vacated and dismissed the case. The Republican candidates and voters appealed to the U.S. Supreme Court, which denied their petition.
This case was one of the lawsuits former President Donald Trump and his allies brought in an effort to overturn the results of the 2020 election.
