An anti-voting lawsuit seeking access to New Jersey voter roll maintenance records.
Background
The Republican National Committee, New Jersey Republican State Committee, Rep. Tom Kean Jr. and state Sen. Anthony Bucco filed a lawsuit against New Jersey Secretary of State Dale Caldwell and election officials in Bergen, Middlesex, Hudson, Union and Somerset counties.
The lawsuit seeks records related to how New Jersey maintains its voter rolls, including information about voters removed from the rolls, inactive voters, address confirmation notices and communications with state and federal agencies.
Plaintiffs argue that the state and counties failed to fully respond to their July 31 records requests under the National Voter Registration Act. The lawsuit asks the court to order the officials to turn over the requested records.
Why It Matters
This is the RNC’s latest effort to obtain broad voter roll records in New Jersey after an earlier case was dismissed for lack of standing.
The lawsuit follows New Jersey’s disclosure that a Motor Vehicle Commission software failure erroneously registered roughly 6,600 people who had indicated they were not U.S. citizens, an incident Republicans have used to push for broader access to voter list maintenance records.
Voting rights advocates warn that lawsuits seeking sweeping voter roll data can fuel efforts to pressure election officials and justify aggressive voter purges, which risk removing eligible voters.
