A pro-voting lawsuit seeking records regarding ICE’s investigations of alleged voter fraud and noncitizen voting.
Background
Democracy Forward Foundation (DFF) sued U.S. Immigration and Customs Enforcement (ICE) and the U.S. Department of Homeland Security for failing to respond to Freedom of Information Act (FOIA) requests regarding ICE’s increased involvement in investigating voter fraud. After ICE’s Homeland Security Investigations office issued a memorandum that required employees review all open and closed voter fraud cases, DFF submitted multiple FOIA requests seeking documents that “shed light on ICE’s investigation of alleged voter fraud and noncitizen voting.”
Why it matters
The Trump administration has spread conspiracies of illegal, non-citizen voting since Trump lost the 2020 election. DHS Secretary Mullin has also threatened to prosecute state officials who refuse to cooperate with DHS. A memo that has federal agents review open and closed cases of voter fraud could chill participation by naturalized citizens. Records already obtained through similar requests show how large ICE’s election related operation is.
