North Carolina Voter Registration Identification Information Challenge

Republican National Committee v. North Carolina State Board of Elections

Lawsuit filed by the Republican National Committee and the North Carolina Republican Party against the North Carolina State Board of Elections and all of its members challenging the state’s voter registration procedures. The Help America Vote Act (HAVA) requires that individuals must provide either a driver’s license or social security number to register to vote before a state can process the application. The plaintiffs claim that prior to December 2023, North Carolina used an application form that did not inform voters that a driver’s license or social security number was required. They allege the state processed over 225,000 voter registration applications without collecting the required identification information and refused to take immediate action to identify and remove unqualified voters from North Carolina’s voter rolls. The plaintiffs argue the state’s actions violate Section 303 of HAVA and North Carolina law, and ask the court to order the state board of elections to develop and implement HAVA-compliant voter registration procedures before Sept. 6, 2024. They also ask the court to order the board to remove all ineligible registrants from the state’s voter rolls, or require that registrants who did not provide HAVA-compliant identification vote on a provisional ballot in all upcoming elections until the identification is provided. 

STATUS: The Republican plaintiffs filed their complaint on Aug. 23, 2024. The North Carolina State Board of Elections has not responded yet.
