North Carolina Supreme Court 2024 Election Protests Rejection Challenge
Griffin v. North Carolina Board of Elections
Petition filed by Republican candidate for the North Carolina Supreme Court, Judge Jefferson Griffin, against the North Carolina State Board of Elections seeking to pause certification of the 2024 state Supreme Court Seat 6 election results and disqualify 60,000 ballots. On Nov. 19, 2024, Griffin filed election protests in each of North Carolina’s 100 counties challenging thousands of ballots cast by voters with allegedly incomplete voter registrations, overseas voters who have never resided in North Carolina and overseas voters who did not provide photo ID with their absentee ballots. On Dec. 13, the board ruled to count the approximately 60,000 challenged ballots in the final results.
Griffin argues the board wrongly decided to count these ballots, and asks the North Carolina Supreme Court to order the board to discount the challenged ballots and correct the final count accordingly. He also asks the court to temporarily stay the board from certifying the state Supreme Court election results until this proposed correction is made. He requests that the court issues its decision on the stay by Dec. 23, 2024. Finally, Griffin asks the court to waive the 10-day deadline to file a petition in the superior court to allow the state Supreme Court to decide the matter.
Griffin filed his petition in the North Carolina Supreme Court on Dec. 18, 2024. On Dec. 19, 2024, the North Carolina State Board of Elections motioned to move the case to federal court, where litigation will continue. Two motions are in progress before the federal court.
STATUS: On Jan. 6, 2025, the district court demanded Griffin’s motion for preliminary injunction back to the North Carolina Supreme Court to decide on its merits.
On Jan. 7, the state board appealed the decision to the 4th U.S. Circuit Court of Appeals. Oral argument has been scheduled for Jan. 27 before the 4th Circuit.
On Jan. 7, the North Carolina Supreme Court blocked the certification of the 2024 state Supreme Court election results while litigation is also ongoing.
