North Carolina Supreme Court Race Election Protest Delay Challenge

Griffin v. North Carolina State Board of Elections

Lawsuit filed by Republican candidate for the North Carolina Supreme Court, Judge Jefferson Griffin, against the North Carolina State Board of Elections challenging the board’s delay in issuing a decision on his protests over the results of the 2024 state Supreme Court race. On Nov. 19, 2024, Griffin filed election protests in each of North Carolina’s 100 counties challenging thousands of ballots cast by voters with allegedly incomplete voter registrations, overseas voters who have never resided in North Carolina and overseas voters who did not provide photo ID with their absentee ballots. The board scheduled oral argument over Griffin’s protests for Dec. 11, 2024 — two days after Griffin asked for a final decision to be issued. Griffin claims that the board’s delay in deciding these challenges undermines the public’s trust in the election and asks the court to order the board to make its final decision on the challenged votes no later than Dec. 10, 2024. Democratic incumbent, Justice Allison Riggs, won Seat 6 on the state Supreme Court after a recount on Dec. 3, 2024 affirmed the initial results.

Shortly after filing his petition in the Wake County Superior Court, Griffin filed a second petition in the North Carolina Court of Appeals requesting the same relief. 

RESULT: On Dec. 9, 2024, the Wake County Superior Court denied Griffin’s petition. The petition in the North Carolina Court of Appeals was denied on Dec. 10, 2024.
