Nevada Washoe County Voter Roll Maintenance Challenge 

Kraus v. Burgess

Petition filed by the Public Interest Legal Foundation (PILF) and a voter against Washoe County Registrar of Voters Cari-Ann Burgess challenging the maintenance of the county’s voter rolls. PILF alleges that there are nearly 50 commercial addresses listed in Washoe County’s voter rolls, which violates a state law which requires voters to provide a residential address when they register to vote. It also alleges that on April 11, 2024, the organization informed Burgess of the issue and asked her office to investigate, but did not receive a response indicating any investigation or corrections to the county’s voter rolls took place. PILF argues that under state law the county must maintain and ensure the accuracy of the county’s voter rolls. PILF asks the court to order Burgess to investigate voters registered at commercial addresses and correct the voter rolls.

The plaintiffs filed their complaint on May 10, 2024.

On May 28, 2024, three pro-voting groups filed a motion to intervene and defend the county’s voter roll practices.

On July 16, 2024, the court denied the pro-voting groups motion to intervene.

On Aug. 20, 2024, the judge denied a motion to dismiss this case.

RESULT: On Jan. 27, 2025, the court dismissed this case on standing grounds. The Washoe County Registrar has not removed any voters from the rolls as a result of this lawsuit.
