Nevada Photo ID Ballot Initiative Challenge III

Lawsuit filed on behalf of a Nevada voter against the Nevada secretary of state challenging a Republican-led ballot initiative seeking to create strict ID rules for future elections. The initiative, which is nearly identical to one filed by R.I.S.E. Nevada earlier this year that was blocked by a state court in July, seeks to create a new photo ID requirement for in-person voting, limit acceptable IDs that voters can present to cure a mismatched signature and require the state to provide free photo IDs to voters who don’t have photo IDs bearing their signatures. However, the petition does not outline a way for the state to raise funds to finance the free photo IDs, allegedly making it an unfunded government mandate that modifies voting rules without containing a funding mechanism. The plaintiff points out that R.I.S.E.’s first ballot initiative was blocked for similarly failing to provide a funding mechanism. The lawsuit asks the court to invalidate the ballot initiative and prohibit it from appearing on any future ballots. On Aug. 30, R.I.S.E Nevada withdrew the ballot petition.
