Georgia DeKalb County Voter Challenges Lawsuit

Lawsuit filed by the DeKalb County Republican Party and a voter against members of the DeKalb County Board of Registration and Elections (BRE) challenging their refusal to consider voter challenges. Under Georgia law, any voter may challenge another voter’s eligibility, under certain circumstances, and request that they be removed from voter rolls. In August, the voter plaintiff filed three separate challenges requesting that the DeKalb BRE remove hundreds of voters that are registered at nonresidential addresses, who have changed their permanent residence or who “should have already been removed.” On Sept. 12, the DeKalb BRE passed a resolution affirming that it would not consider voter challenges within 90 days of an election, in compliance with the National Voter Registration Act (NVRA). The BRE also stated within the resolution that individual voter challenges violated the NVRA as a “program of systematic removal.” The plaintiffs argue that removing voters based on individualized information does not qualify as systematic removal and is permitted within 90 days of an election. The plaintiffs ask the court to order the BRE to hold a hearing on the three voter challenges and to immediately process the challenges.
STATUS: The plaintiffs filed their complaint on Sept. 17, 2024. The defendants have not responded yet.
