Alabama Voting Machines Challenge

Lawsuit filed on behalf of former gubernatorial candidate Lynda Blanchard (R) and state Rep. Tommy Hanes (R) against Alabama Secretary of State John Merrill (R) and members of the Electronic Voting Committee challenging the use of electronic voting machines used in every Alabama county. The plaintiffs allege that these machines violate Alabama election laws and the Alabama Constitution’s Due Process Clause because they fail “to provide a reasonable and adequate method for voting by which Alabama electors’ votes would be accurately counted” and are “subjecting voters to cast votes on an illegal and unreliable system.” They request that the court order that electronic voting machines are unconstitutional, prevent the future use of electronic voting machines and request that the court order a hand count of the November 2022 election results. Alabama Attorney General Steve Marshall (R) asked the judge to throw out the lawsuit on July 21. On Aug. 19, Blanchard asked the court to dismiss her claims. On Sept. 12, the court dismissed the lawsuit.
