Washington King County Online Ballot Curing Challenge

Washington State Republican Party v. King County

Lawsuit filed by the Washington State Republican Party (WA GOP) against King County and its director of elections, Julie Wise, challenging the county’s decision to accept ballots that voters cured through an online third-party tool, OmniBallot, during the Aug. 6 primary election for commissioner of public lands. WA GOP alleges that the Republican candidate, Sue Kuhel Paderson, would have advanced to a general election if King County had not counted 2,092 ballots cured using OmniBallot. The plaintiff argues the county’s use of the tool violates a state election law that requires election officials to accept ballots cured electronically only if they are received securely and directly — not through third-party tools. WA GOP asks the court to declare the OmniBallot system and ballots cured with it invalid and block King County from using it.

STATUS: WA GOP filed its lawsuit on Sept. 5, 2024. King County has not responded yet.
