Texas 135th State House District Election Contest
May v. Rosenthal
Election contest filed by Mike May, the Republican candidate for the 135th state House District, who lost to Jon Rosenthal, the Democratic candidate for the 135th State House District, by a margin of 16%. May claims that the outcome of the Nov. 8 election is “not true…because an election officer or other person officially involved in the administration of the election prevented eligible voters from voting.” In his petition, May alleges that many Harris County voters could not vote on Election Day due to paper shortages at numerous polling locations. May asks the court to declare the election results for the 135th state House District race “void” and to order a new election. Under state law, May’s contest will be reviewed by state legislators (rather than a judge) since it involves a State House race.
On Jan. 11, 2023, Texas House Speaker Dade Phelan (R) dismissed May’s election contest, ruling that May did not properly submit his claims and failed to comply with procedures required by Texas law.
