Pennsylvania Undated and Wrongly Dated Mail-in Ballots Challenge (RNC)

Petition filed by the Republican National Committee (RNC) and Republican Party of Pennsylvania against all 67 Pennsylvania county boards of elections asking the Pennsylvania Supreme Court to reaffirm its order to reject mail-in ballots with an undated or wrongly dated outer envelope in the November 2024 general election. The Republican petitioners claim that some counties — including Bucks County, Centre County and Philadelphia — chose to count undated or wrongly dated mail-in ballots in the November 2024 general election. They argue this violates the state Supreme Court’s orders in two related lawsuits, which prohibited the counting of undated or wrongly dated mail-in ballots in the November election. The Republican petitioners ask the state Supreme Court to reaffirm its earlier decisions and order Pennsylvania’s county board of elections not to count undated or wrongly dated mail-in ballots in the November election. 

RESULT: On Nov. 18, 2024, the Pennsylvania Supreme Court clarified that undated and wrongly dated mail-in ballot won’t be counted for the November 2024 general election.
