Georgia Mail Ballot Delays Challenge

Olaribigbe v. Phillips

A pro-voting lawsuit alleging that nearly 2,900 residents in Cobb County have not yet received their mail ballots with just a week left before Election Day.

Background

A Cobb County voter sued the Cobb County Board of Elections (the Board) for failing to send mail ballots on time to voters who requested them under state law. The complaint alleges that “thousands of Cobb County voters did everything right by requesting their absentee ballots weeks in advance of Georgia’s election-day receipt deadline, yet they have been left in the cold with no absentee ballot at all.” Plaintiff alleges that the Board’s failure to send these ballots violates Georgia state law, which requires mail ballots to be sent out no later than three days after a timely application is received, and also the state constitution. The plaintiff is asking for a court order requiring the board to send by express overnight mail an absentee ballot to all affected voters

Why It Matters

This lawsuit comes just a week before Election Day. Cobb County’s alleged failure to deliver legitimately requested mail ballots on time risks disenfranchising thousands of voters. The county is a major Democratic stronghold, where 57% of voters supported Vice President Kamala Harris in 2024. Georgia hosts a pivotal U.S. Senate race this year.
