Georgia Gwinnett County Mail Ballot Delays Challenge

Huntington v. Williams

A pro-voting lawsuit alleging that 1,820 residents of Gwinnett County have not yet received their mail ballots with less than a week until Election Day.

Background

A Gwinnett County voter sued the Gwinnett County Board of Elections for failing to send mail ballots on time to voters who requested them under state law. The complaint alleges that as many as 1,820 voters may be affected as a result of the delay, and that voters who are out of state will not be able to vote without a mail ballot. The complaint further alleges that the elections board outsourced its “mailing apparatus” to an out-of-state private vendor, which is also used by other Georgia counties experiencing mail ballot delays. The lawsuit requests the board send a mail ballot to each affected voter by overnight mail.

Why It Matters

This lawsuit comes less than a week before Election Day. Gwinnett County’s alleged failure to deliver legitimately requested mail ballots on time risks disenfranchising thousands of voters. Other counties in Georgia have experienced similar delays. Georgia hosts a pivotal U.S. Senate race this year.
