Frisbie v. Calhoun County Board of Canvassers
Lawsuit filed by Republican candidate for Michigan House of Representatives, Steve Frisbie, and the Committee to Elect Steve Frisbie to State House against the Calhoun County Board of County Canvassers seeking to stop the re-tallying of absentee ballots cast in the November 2024 general election. On Nov. 12, 2024, the Calhoun County Board of County Canvassers voted to recount the absentee ballots cast in Battle Creek after the county’s results — which were updated after a discrepancy was discovered with Battle Creek’s absentee ballots — showed Frisbie leading his race by only 58 votes. Frisbie claims that the board’s decision to recount the results in Battle Creek before finishing its review of the statement of returns from the election violates Michigan election law. He asks the court to prohibit Calhoun County from conducting a recount until the county has finished reviewing the statement of returns.
RESULT: On Nov. 13, 2024, the court dismissed the case. Calhoun County can continue its recount of the November 2024 election results in Battle Creek.
