Pennsylvania Bucks County Undated or Wrongly Dated Mail-in Ballots Challenge
McCormick v. Bucks County Board of Elections
Lawsuit filed by Republican candidate for U.S. Senate, David McCormick, the Republican National Committee (RNC) and the Republican Party of Pennsylvania against the Bucks County Board of Elections challenging the board’s decision to count 405 mail-in ballots submitted with undated or wrongly dated outer envelopes in the November 2024 general election. The Republican plaintiffs argue that the decision violates Pennsylvania law and the Pennsylvania Supreme Court’s decision in a similar lawsuit — which prohibited the counting of undated or wrongly dated mail-in ballots in the November 2024 election. They ask the court to order Bucks County not to count the 405 undated or wrongly dated mail-in ballots in the November 2024 election results.
RESULT: The Republican plaintiffs filed their complaint on Nov. 13, 2024. On Nov. 19, the parties agreed that the board shall not counted any undated or wrongly dated mail-in ballots, citing a recent Pennsylvania Supreme Court ruling.
