League of Women Voters of New Jersey v. Ocean County Board of Elections

A pro-voting lawsuit challenging Ocean County officials’ attempt to purge Democratic and unaffiliated voters ahead of the November 2026 general election.

Background

The League of Women Voters of New Jersey and three Bay Head voters sued the Ocean County Board of Elections and its chair, George Gilmore. The lawsuit challenges letters sent to dozens of Democratic and unaffiliated voters requiring them to complete a lengthy “Domicile Questionnaire,” confirm whether they would attend an Oct. 13 board meeting and appear to defend their eligibility to vote.

Plaintiffs argue the voters were targeted after the president of the Bay Head GOP sent county officials a list of 39 voters — all Democratic or unaffiliated — claiming they should not be allowed to vote in Bay Head because their tax bills were mailed elsewhere.

Plaintiffs claim the effort violates the John R. Lewis Voter Empowerment Act of New Jersey and the New Jersey Constitution by intimidating voters, treating similarly situated voters differently and burdening the fundamental right to vote.

Why It Matters

This case is one of the first major lawsuits brought under New Jersey’s new John R. Lewis Voter Empowerment Act, which was enacted in 2026 to strengthen state-level voting protections. Plaintiffs argue Ocean County’s process could scare eligible voters away from participating, force them to cast provisional ballots or result in their removal from the rolls just before the Nov. 3 general election. The lawsuit also raises concerns about partisan voter challenges, alleging that only non-Republican voters were targeted even though similarly situated Republican voters were not.
