New Jersey Voter List Maintenance Records Challenge (RNC)

An anti-voting lawsuit seeking to compel New Jersey to provide the RNC with access to voter list maintenance records.

Background

The Republican National Committee (RNC) filed a lawsuit against New Jersey Secretary of State Tahesha Way (D) for refusing to provide voter list maintenance information. On March 25, the RNC submitted a public records request seeking sixteen categories of voter list maintenance records. With that request still pending, the RNC submitted a second request on June 16 seeking additional information about voters who had asked to be removed from the rolls. According to the lawsuit, Way ultimately denied most of the RNC’s requests in July, refusing to provide 15 of the 18 categories of requested records. The RNC argues that this refusal violates the National Voter Registration Act’s public-disclosure requirements, and is asking the court to order the state to turn over the withheld records, including all documents concerning New Jersey’s voter list maintenance activities and all records concerning individuals removed from the voter rolls over the past two years. 

Why It Matters

This is part of a broader, rapidly intensifying national effort by Republicans to force states to disclose sensitive voter registration data and pave the way for aggressive voter roll purges. The case closely mirrors a wave of lawsuits the DOJ has filed in recent months against states – including New Hampshire, California, Michigan, New York, Minnesota, Pennsylvania, Oregon, and Maine – for refusing to turn over unredacted statewide voter registration lists.
