New Jersey Atlantic County Unsealed Mail-in Ballots Challenge

In the Matter of Atlantic County Board of Elections

Petition filed on behalf of the Atlantic County Board of Elections seeking a court determination on whether prematurely unsealed mail-in ballots cast in the June 4, 2024 primary election should be counted. The board deadlocked on whether to count or reject the 1,909 mail-in ballots with inner envelopes that were accidentally opened ahead of the election, and ask the court to break the board’s tied vote. On June 7, 2024, the court ordered that the disputed mail-in ballots be counted. 

RESULT: On June 7, 2024, the court allowed the contested ballots to be counted in the June 2024 primary election.
