RNC v. Bergen County Board of Elections

An anti-voting lawsuit brought by the RNC seeking access to records identifying poll workers assigned to early voting sites in Bergen County, New Jersey during the 2025 general election.

The Republican National Committee (RNC) filed a lawsuit against the Bergen County Board of Elections, alleging violations of New Jersey’s Open Public Records Act (OPRA) and the common law right of access. The lawsuit stems from a public records request submitted last year in which the RNC sought lists of poll workers assigned to each early voting site and district in the county for the Nov. 4, 2025 General Election, including the workers’ political party affiliations and any vacancies. According to the complaint, the Board denied the request Jan. 8, asserting that the information was exempt from disclosure under OPRA’s security-related provisions. The RNC argues the denial was unlawful and is asking the court to order the Board to produce the requested records. 

The RNC has repeatedly used the courts to push for an increase in Republican representation among poll workers. In this case, the RNC is seeking the public release of private information about poll workers, even as threats and harassment against election officials have been on the rise. 

  • March 27, 2026: Hearing scheduled on the order to show cause.
  • March 3, 2026: The court ordered the Board to show cause why it should not be required to turn over the requested records to the RNC.
  • March 2, 2026: RNC filed its complaint.
