Nevada Noncitizen Voter Roll Maintenance Challenge
Dagusen v. Aguilar
Lawsuit filed by the Republican National Committee (RNC), Nevada Republican Party (NV GOP), Donald J. Trump for President 2024 and a voter against Nevada Secretary of State Francisco Aguilar (D), Democratic National Committee (DNC) and Nevada State Democratic Party (NSDP) challenging the state’s practices for voter roll maintenance and citizenship verification. The plaintiffs allege that state department of motor vehicles’ data shows that over 6,000 potential noncitizens have registered to vote in Nevada and nearly 4,000 of them voted in the 2020 general election. They argue that the secretary of state has not taken adequate steps to remove these individuals from the voter rolls, in violation of state law. They also argue that allowing alleged noncitizens to register or vote violates other voters’ rights to equal protection, due process and to vote under the state constitution. They ask the court to order the secretary of state to implement a new program for regular voter roll maintenance and verify that all registered Nevada voters are U.S. citizens before the 2024 general election.
STATUS: The plaintiffs filed their lawsuit on Sept. 11, 2024. The defendants have not responded yet.
