Michigan Kalamazoo County Certification Duty Challenge
ACLU of Michigan v. Froman
Lawsuit filed by the American Civil Liberties Union of Michigan (ACLU-MI) and two Kalamazoo voters against a member of the Kalamazoo County Board of Canvassers, Robert Froman, challenging his preemptive refusal to certify the results of the 2024 election if he believes they are “stolen” or fraudulent. ACLU-MI argues that the board of county canvassers has a mandatory duty to certify election results under the state’s constitution and election law. The plaintiffs also argue that not certifying the 2024 election results would disenfranchise Kalamazoo voters and violate their fundamental right to vote under the state constitution. They ask the court to rule that Froman has a duty to certify election results.
RESULT: On Sept. 10, 2024, the case was dismissed after Froman signed an affidavit swearing he would certify the November election results.
