McCormick v. Centre County Board of Elections
Lawsuit filed by Republican candidate for U.S. Senate, David McCormick, the Republican National Committee (RNC) and the Republican Party of Pennsylvania against the Centre County Board of Elections challenging the board’s decision to count three mail-in ballots submitted with undated or wrongly dated outer envelopes in the November 2024 general election. The Republican plaintiffs argue that the decision violates Pennsylvania election law and the Pennsylvania Supreme Court’s decision in a similar lawsuit — which prohibited the counting of undated or wrongly dated mail-in ballots in the November 2024 general election. They ask the court to order Centre County not to count the three undated or wrongly dated mail-in ballots in the November 2024 election results.
RESULT: After the Republican plaintiffs filed their petition on Nov. 14, 2024, they subsequently withdrew their challenge to two out of the three challenged ballots. The court dismissed the challenge to the outstanding ballot since it was contested too late under state law, rendering the challenge untimely.
