Alaska Rejected Absentee Ballots Records Request Challenge

Alaskans for Mary v. Dahlstrom

A pro-voting lawsuit seeking records about absentee ballots rejected in Alaska’s 2026 midterm elections.

Background

Alaskans for Mary, the campaign supporting U.S. Senate candidate Mary Peltola, filed a lawsuit against Alaska election officials alleging they violated state law by refusing to provide records about absentee ballots rejected during the 2026 midterm elections. According to the lawsuit, on Oct. 27, Alaskans for Mary submitted a request to each regional office of the Division of Elections seeking “a copy of the Absentee Register showing the accept or reject code for each absentee ballot returned for the 2026 General Election, or any other documents sufficient to show the identities of voters whose absentee ballots for the 2026 General Election have been rejected as well as the reasons for each rejection.” Alaskans for Mary argues that state officials’ refusal to provide the requested records violates the Alaska Public Records Act and are asking the court to order the requested records be provided.

Why It Matters

This lawsuit comes as Alaska continues counting ballots in its closely watched U.S. Senate race and amid broader efforts by the Trump administration to influence the state’s election process.
