Georgia Counties Ballot Return Sites Challenge

Republican National Committee v. Mahoney

Lawsuit filed by the Republican National Committee and Georgia Republican Party against members of the county board of elections in seven different counties challenging their policies allowing voters to hand deliver their absentee ballots to county election offices from Nov. 2 – 4. The plaintiffs argue this violates a state law that requires early voting to end on the Friday before Election Day, which was Nov. 1. They also argue that allowing absentee voters in these counties to return their ballots during this period gives them an unfair advantage over voters in other counties across the state, in violation of the Equal Protection Clause of the Fourteenth Amendment. They ask the court to block these counties from accepting absentee ballots returned to their election offices from Nov. 2 – 4.

The plaintiffs filed their complaint on Nov. 3, 2024.

RESULT: On Nov. 5, a district court judge denied a motion for a preliminary injunction to block the counties from accepting the hand-delivered ballots. On Nov. 7, the RNC voluntarily dismissed the case.
