Public Interest Legal Foundation v. Fontes

An anti-voting lawsuit seeking access to Arizona’s voter roll maintenance data.

Background

The conservative Public Interest Legal Foundation (PIlF) sued Arizona Secretary of State Adrian Fontes (D), alleging a failure to produce voter roll maintenance records identifying voters who were mistakenly removed as deceased. As a member of the Electronic Registration Information Center (ERIC), Arizona receives “deceased reports” detailing a list of voters who may be deceased and should subsequently be removed from state voter rolls. ERIC also issues “retraction reports” to correct erroneous mistakes in previous deceased reports and ensure voters are not unfairly removed from the rolls. PILF argues Arizona violated the National Voter Registration Act by failing to maintain these records and refusing to make them available to the public. They are asking the court to declare the state is in violation of the NVRA and to require it  to keep ERIC Retraction Reports for at least two years.

Why It Matters

PILF uses these types of lawsuits to question the accuracy of states’ voter rolls and challenge  their list maintenance policies, with the end goal of making it easier to remove voters from the rolls.
