Arizona Non-Resident Overseas Voters Challenge

Republican Party of Arizona v. Arizona

An anti-voting lawsuit from Republicans challenging the constitutionality of allowing overseas U.S. citizens to vote in Arizona elections.

Background

The Republican National Committee (RNC), in coordination with the Republican Party of Arizona, is suing the Arizona Secretary of State (D) in state court over a law permitting U.S. citizens overseas to register to vote in Arizona if one of their parents is a registered voter in the state. The RNC claims that this law directly conflicts with Arizona’s constitution, which requires people to be residents of the state in order to vote there. The RNC is seeking a court order declaring the law to be unconstitutional and prohibiting the Secretary of State from accepting voter registrations and mail ballot requests from people who have never resided in Arizona.

Why It Matters

This action is part of Republicans’ nationwide legal strategy to perpetuate claims of ineligible voters casting ballots in American elections.
