Election Contest Against GA Senators Dismissed
WASHINGTON, D.C. — Today, the Fulton County Superior Court dismissed one of the last remaining lawsuits contesting the election of Georgia Sens. Jon Ossoff (D) and Raphael G. Warnock (D). The petition, filed by an individual Georgia voter, alleged numerous issues with the November 2020 general election and a problem with voting in one specific county for the January 2021 runoff elections when Ossoff and Warnock were declared victors. The lawsuit sought to remove both senators from their duly-elected positions and asked the court to mandate new statewide elections to fill the positions.
The court dismissed the contest with prejudice, finding that the contestant failed to properly serve all of the named defendants and that he did not file his petition in a timely manner. All but one of the issues raised relate to the Nov. 3, 2020 general election, yet the contestant waited until Jan. 25, 2021 to lodge his complaint which, the court wrote, “bars him from contesting those results now under Georgia’s contest statute.” The court also flatly rejected the contestant’s demand for a new election, writing that doing so would “do serious (and, likely, permanent) damage to the integrity of the state’s elections system, and would, undoubtedly, cost the State and its taxpayers millions of dollars.”
