McCormick v. Montgomery County Board of Elections
Lawsuit filed by Republican candidate for U.S. Senate, David McCormick, the Republican National Committee (RNC) and the Republican Party of Pennsylvania against the Montgomery County Board of Elections challenging the board’s decision to count 501 mail-in ballots submitted with undated or wrongly dated outer envelopes in the November 2024 general election. The Republican plaintiffs claim the decision violates Pennsylvania law and the Pennsylvania Supreme Court’s decision ahead of the November 2024 election — which prohibited the counting of undated or wrongly dated mail-in ballots in the upcoming election. They ask the court to prohibit Montgomery County from counting undated or wrongly dated mail-in ballots in the November 2024 election results.
RESULT: In light of a recent Pennsylvania Supreme Court ruling prohibiting the counting of undated or wrongly dated mail-in ballots, the board did not count the contested ballots. The petition was dismissed on Nov. 22, 2024.
