Pennsylvania Monroe County Undated Ballots and Provisional Ballot Missing Signature Challenge
McCormick v. Monroe County Board of Elections
Lawsuit filed by Republican candidate for U.S. Senate, David McCormick, the Republican National Committee (RNC) and the Republican Party of Pennsylvania against the Monroe County Board of Elections challenging the board’s decision to count 42 mail-in ballots submitted with undated or wrongly dated outer envelopes and 23 provisional ballots missing the voter’s signature in the November 2024 general election. The Republican plaintiffs claim the decision to count the 42 undated or wrongly dated mail-in ballots violates Pennsylvania law and the Pennsylvania Supreme Court’s decision ahead of the November 2024 election — which prohibited the counting of undated or wrongly dated mail-in ballots in the upcoming election. They also argue the board’s decision to count 23 provisional ballots missing a voter signature violates state law — which requires provisional ballots to be signed by the voter. The Republican plaintiffs ask the court to prohibit Monroe County from counting the challenged undated or wrongly dated mail-in ballots and provisional ballots missing a voter’s signature in the November 2024 election results.
RESULT: The Republican plaintiffs filed their petition on Nov. 16, 2024. On Nov. 20, the court concluded that the 42 mail-in ballot with date issues won’t count in light of a recent Pennsylvania Supreme Court ruling. As to the 23 provisional ballots with missing signatures, the court concluded that they must be disqualified.
