Pennsylvania Centre County Undated and Wrongly Dated Mail-in Ballot Challenge

Schellberg v. Centre County Board of Elections

Petition filed by Centre County GOP Chair Michelle M. Schellberg and 17 local voters against the Centre County Board of Elections challenging the county’s decision to count undated or wrongly dated mail-in ballots during the 2024 primary elections. The plaintiffs allege that the board of elections counted 95 undated or wrongly dated mail-in ballots, including several ballots with dates missing the month, day, year or those that had a wrong date altogether. The plaintiffs argue that a 2022 decision from the Pennsylvania Supreme Court and 2023 decision from the 3rd U.S. Circuit Court of Appeals prohibit Pennsylvania counties from counting undated or incorrectly dated ballots. The voters ask the court not to certify the results of the 2024 primary elections and stop the board of elections from counting wrongly or incorrectly dated mail-in ballots in future elections.

RESULT: On May 24, 2024, the district court dismissed the case. The challenged ballots will be counted.
