Republican National Committee v. Whitmer
Lawsuit filed by the Republican National Committee (RNC), Donald J. Trump for President 2024, the Michigan Republican Party and a local election official against Michigan Gov. Gretchen Whitmer (D), Michigan Secretary of State Jocelyn Benson (D), the U.S. Department of Veteran Affairs (VA), the U.S. Small Business Administration (SBA) and other election officials challenging new voter registration agencies designated by Whitmer in December 2023. On Dec. 18, 2023, Whitmer designated several new agencies, including the VA and SBA, as official voter registration agencies in her Executive Directive 2023-6. The plaintiffs claim that this directive violates state law by designating new voter registration agencies without the approval of the state legislature. They also argue that these voter registration agencies violate Section 7 of the National Voter Registration Act (NVRA) and the Administrative Procedures Act (APA) because they were not lawfully designated by the state of Michigan. They ask the court to prohibit the state from using the VA and SBA to register voters. They also ask that any future directives establishing voter registration agencies without permission of the Legislature be declared invalid.
RESULT: On Nov. 22, the GOP plaintiffs voluntarily dismissed the case.
