RNC v. Fairfax County Electoral Board

An anti-voting lawsuit challenging  Fairfax County’s policies surrounding the eligibility of voters suspected to be noncitizens.

Background
The Republican National Committee filed a lawsuit against the Fairfax County Electoral Board claiming that its Election Officer Training Notebook does not expressly require officers to challenge the eligibility of voters who present a Driver Privilege Card (DPC), a form of ID used by noncitizens. The RNC alleges that this is in violation of state law, and they are asking the court to preliminarily and permanently block the county from using the training notebook’s allowance of unchallenged voting for people with DPCs.

Why it Matters
The lawsuit comes amid a broader push by Republicans to enact proof of citizenship requirements for voting purposes, under the false claim of widespread noncitizen voting. The lawsuit also cites the Apr. 21 special election on redistricting Virginia’s congressional maps, which the Republicans oppose. The RNC claims that the election would become “vulnerable to non-citizen participation,” despite repeated findings that such instances are exceedingly rare. However, such challenges could lead to otherwise eligible voters being disenfranchised.
