An anti-voting lawsuit challenging the implementation of California’s new congressional map following the passage of Proposition 50. 

Background

The California Republican Party and voters filed a lawsuit in federal court challenging the constitutionality of the state’s new congressional map implemented after the passage of Proposition 50. Plaintiffs assert the new map is a racial gerrymander favoring Hispanic voters, in violation of the U.S. Constitution’s Fourteenth and Fifteenth Amendments. The lawsuit seeks to block the new congressional map.

Why It Matters

On Nov. 4, California voters overwhelmingly voted in favor of Proposition 50 to implement a new congressional map that adds five more seats for Democrats. The new map is a response to Texas’ gerrymander demanded by President Donald Trump to help Republicans retain control of the House in 2026. The California Supreme Court and federal courts have already rejected five lawsuits challenging the state’s redistricting plan.

  • Dec. 15, 2025: The court will hold a hearing on plaintiffs’ motion for a preliminary injunction to block the new congressional map.
  • Dec. 5, 2025: The DCCC filed a notice of supplemental authority in light of the U.S. Supreme Court’s decision to allow the new Texas map to be in effect for the 2026 midterm election.
  • Dec. 3, 2025: Defendants filed their oppositions to plaintiffs’ motion for a preliminary injunction.
  • Nov. 21, 2025: The district court granted LULAC’s motion to intervene as a defendant, but denied the California voters their motion to intervene as defendants.
  • Nov. 19, 2025: Defendants asked the court to move the preliminary injunction hearing to Jan. 2026 to allow parties sufficient time to conduct discovery. Plaintiffs filed their opposition to LULAC’s motion to intervene as a defendant.
  • Nov. 17, 2025: The DOJ filed their complaint. A group of California voters filed a motion to intervene as defendants.
  • Nov. 16, 2025: The League of United Latin American Citizens (LULAC) and Cervantes seeks to intervene as a defendant in the lawsuit.
  • Nov. 14, 2025: The DOJ’s motion to intervene as a plaintiff was granted.
  • Nov. 13, 2025: The U.S. Department of Justice (DOJ) seeks to intervene as a plaintiff in the lawsuit. The DOJ also filed a motion for preliminary injunction. A three-judge panel was appointed to hear the challenge to California’s Proposition 50 congressional map.
  • Nov. 12, 2025: The DCCC’s motion to intervene as a defendant was granted.
  • Nov. 10, 2025: The Democratic Congressional Campaign Committee (DCCC) seeks to intervene as a defendant in the lawsuit.
  • Nov. 7, 2025: California GOP and voters filed a motion seeking to block the state’s new congressional map.
  • Nov. 5, 2025: California GOP and voters filed their complaint.
