Election Contest Continues Over 22 Ballots in IA-02

WASHINGTON, D.C. Rita Hart, Democratic candidate for Iowa’s 2nd Congressional District, has filed a response brief in the U.S. House to Republican Mariannette Miller-Meeks’s motion to dismiss Hart’s election contest.

This election was one of the closest races in 2020 — the final margin only separated the candidates by six votes. In an initial notice of contest, Hart identified 22 lawful ballots that were wrongfully thrown out. When counted, those votes will put Hart ahead by nine votes and make her the lawful winner of the congressional seat.

In Miller-Meeks’s motion to dismiss, she does not dispute the validity of these ballots but instead focuses on a procedural requirement with no basis in the law. In her latest response, Hart emphasized the need to ensure all legally cast ballots are counted in this ongoing race.
