Pennsylvania Perry County Provisional Voting Accessibility Request

In re: 2024 General Election

Petition filed by the Perry County Board of Elections seeking to allow designated agents to obtain and return provisional ballots for voters with disabilities who cast a potentially defective mail-in or absentee ballot. In Pennsylvania, voters who cast a defective absentee ballot may vote provisionally in-person on Election Day. On Oct. 28, 2024, the board received notice from Disability Rights Pennsylvania informing the county that some voters with disabilities may not be able to physically travel to a polling location on Election Day to cast a provisional ballot. The board asks the court to allow designated agents to obtain and return provisional ballots for voters with disabilities. 

RESULT: The Perry County Board of Elections filed its petition on Nov. 4, 2024. The court granted the board’s request, meaning voters with disabilities in Perry County can have a designated agent obtain and return their provisional ballots if they believe their mail-in ballot will not be counted.
