Pennsylvania Luzerne County Drop Box Removal Challenge

In This Together NEPA Inc. v. Crocamo

Lawsuit filed by In This Together NEPA and three voters against the Luzerne County Board of Elections and Registration and county manager Romilda Crocamo challenging the county’s decision to eliminate the use of drop boxes. The plaintiffs allege that Crocamo, due to purported safety and security concerns, unilaterally removed drop boxes without the approval of the county board of elections which had previously approved four drop boxes for the county. They argue that this violates a state election law that gives county election boards the sole authority to conduct elections. They argue that authority includes the right to provide mail ballot drop-off locations, including drop boxes. The plaintiffs ask the court to rule that Crocmaco acted outside her authority and order her to implement the drop box locations the board already approved.

STAUS:  After the county agreed to reinstate drop boxes for the upcoming election, the plaintiffs voluntarily withdrew their motion for a preliminary injunction. Litigation is ongoing.
