Background
Juan Medina, a Nevada voter, filed a lawsuit in Nevada state court challenging a ballot initiative seeking to create an independent redistricting commission in the state. The plaintiff asserts the ballot initiative violates the Nevada Constitution’s unfunded-mandate prohibition by requiring the expenditure of state money to fund the Commission without providing a method for raising the necessary revenue. The lawsuit also argues defendants’ petition is barred by issue preclusion as this issue was already decided in Jeng v. Aguilar, which disqualified the ballot initiative.

The plaintiff seeks to block the Secretary of State from adding the current initiative to the ballot.
